Course Description:
There is increasing evidence that articles may release certain chemical substances throughout and at the end of their life cycles. To control possible human and environmental exposures, the U.S. Environmental Protection Agency announced several Significant New Use Rules (SNURs) to end the exemption that allows the import of these chemical substances as components of articles. Long-chain perfluoroalkyl carboxylates (LCPFACs) are commonly used as article surface coatings. In July 2020, EPA finalized a SNUR that requires companies to notify EPA at last 90 days before importing LCPFACs for significant new uses, and cease importing until EPA can review the conditions of use. The types of articles most likely to be affected by this rule include apparel, automotive parts, fibers, carpets, electronic components, paper goods, and construction materials. In January 2021, EPA issued guidance clarifying that importers must determine whether the LCPFAC SNUR applies to any articles they import. If so, importers must develop and execute a compliance strategy that may include elimination or substitution, cessation of importation, or submission of a Significant New Use Notice for articles containing LCPFACs.
