Navigating PFAS-Related Product Stewardship Challenges (PSX 2023 On Demand)

The regulatory landscape concerning per- and polyfluoroalkyl substances (PFAS) continues to create new product stewardship challenges for manufacturers. The Environmental Protection Agency (EPA) recently proposed new reporting requirements for manufacturers and importers of PFAS under the Toxic Substances Control Act (TSCA), with few exceptions. EPA also proposed revisions to the Toxic Release Inventory (TRI) reporting requirements for PFAS that would eliminate previous exemptions to PFAS reporting. On February 7, 2023, the European Chemicals Agency (ECHA) also released a proposal from five EU member nations that would restrict the manufacture, distribution, and use of more than 10,000 fluorinated chemistries. Reliable assessment strategies are an essential part of compliance. However, the development and validation of methods to quantify the amount of individual and groups of PFAS is complicated by the lack of chemical reference standards and consistent analytical methods for complex matrices. In this presentation, we will discuss how we have helped clients navigate emerging and evolving regulations and provide examples of successful product stewardship and compliance programs and testing strategies. This presentation will equip participants with an understanding of recently proposed PFAS regulations and their implications for product stewardship compliance programs.
